Terms & Conditions

These Terms & Conditions apply to all orders placed through the online shop of underjordiske photography.

1. Scope

These Terms & Conditions apply to the sale of photographic prints via this website. All prints are produced on a made-to-order basis.

2. Products

All products offered are photographic prints.
Due to the nature of photography and printing processes, slight variations in color and appearance may occur depending on screen settings and printing materials.

3. Ordering & Contract Conclusion

By placing an order through this website, you submit a binding offer to purchase the selected product(s). The contract is concluded once you receive an order confirmation by email.

4. Prices & VAT

All prices are stated in EUR.
As a small business owner (Kleinunternehmerin) according to § 6 para. 1 item 27 Austrian VAT Act (UStG), no VAT is charged or shown.

5. Payment

Payment is processed via the payment methods displayed at checkout (e.g. PayPal, Stripe). Payment data is handled exclusively by the respective payment service providers and is not stored by underjordiske photography.

6. Production & Shipping

In most of the cases prints are individually produced after an order is placed. Processing time may take up to 14 days before shipment. Shipping is currently available to EU countries only. Orders from outside the EU (e.g. UK or Switzerland) are possible upon request. Shipping costs are calculated and displayed at checkout.

Delivery times are calculated from the date of shipment, not from the order date.

7. Damaged Items

If a print arrives damaged, please contact us within 48 hours of delivery and include a clear photo showing the damage.

No return of the damaged print is required.
A refund will be issued in accordance with applicable consumer protection laws.

8. Right of Withdrawal

Consumers within the EU have a statutory 14-day right of withdrawal.

Due to the nature of made-to-order photographic prints, withdrawal is possible only until the order has been shipped. Once an order has been shipped, withdrawal is only possible if the print arrives damaged or defective.

9. Copyright & Usage Rights

All images remain the intellectual property of R. Burkhart / underjordiske photography, even after purchase. The purchase of a print grants ownership of the physical print only, not the copyright.

10. Liability

Liability for damages is limited to the purchase price of the product, unless caused by intent or gross negligence.

We are not liable for delays caused by shipping providers.

11. Governing Law

These Terms & Conditions are governed by Austrian law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
